A long-time rental owner hires a manager and spends less time on daily work. It can be useful to review prior participation, but owning or self-managing a property for five years does not automatically establish a tax result.
The historical test asks about material participation in the activity during particular prior years. Keep records that explain those years individually.
What the lookback test requires
Test 5 in Treasury Regulation 1.469-5T(a)(5) looks for material participation in any five of the ten immediately preceding tax years, determined without relying on Test 5 itself. The five years need not be consecutive.
For a 2026 calendar-year review, the lookback is 2016 through 2025. The current year is outside that prior-year window. A useful file identifies the basis for each selected year’s participation rather than simply listing five years of ownership.
Rental rules still need attention
Historical participation does not create a permanent exemption from rental passive-activity rules. If your analysis depends on real estate professional status, the current-year qualifying requirements remain relevant. Treasury Regulation 1.469-9 addresses qualifying taxpayers and the treatment of rental real estate activities.
Ask your adviser to assess whether the prior and current activity are the same for this purpose. Changes in grouping, ownership, operations, or the nature of customer use can complicate a simple property-by-property history.
Do not assume a past return’s nonpassive label proves the underlying participation. Keep the supporting facts and any prior professional analysis, including the elections or grouping statements used.
Build a year-by-year index
For each candidate year, record the activity identity, ownership details, participation basis, and location of supporting files. Useful sources can include work logs, calendars, management agreements, contractor records, and correspondence about your own tasks.
An illustrative index entry might read: “2021, Oak Street activity: adviser to review Test 1; work log and calendar in 2021 folder; manager engaged only from November.” That note identifies a question and its source rather than treating an unreviewed total as certification.
If a year’s support is incomplete, mark the gap. Reconstruct only what the available evidence supports, and distinguish a later reconstruction from an original record.
Retain records that support later years
A record may remain relevant beyond the year in which it was created if a later return relies on it. Discuss retention with your adviser before applying a routine deletion schedule to historical participation files.
There is no need to invent a universal “11-year rule” for every rental document. Different records serve different purposes, and applicable retention periods can depend on the return, asset, and unresolved issues.
Before changing systems or closing an account, export the records you need and save original supporting files separately. Archiving, deleting, and downgrading rental records explains product boundaries. HostHours can organize current work, but it cannot certify past qualification from ownership dates or reconstruct missing years automatically.
Clear answers
Frequently asked questions
Must the five participation years be consecutive?
No. Test 5 uses any five of the ten immediately preceding tax years, with material participation determined without relying on Test 5 itself.
Does owning a rental for five years satisfy this test?
No. Ownership alone does not establish material participation. The history must support participation in the relevant activity for the selected prior years.
Does this test permanently establish real estate professional status?
No. Current-year qualifying requirements and rental passive-activity rules still need review. Historical participation is not a permanent REPS designation.
Can I delete old logs once the original return is several years old?
Check first whether a later return relies on those records. Historical participation and other continuing issues can make older documents relevant to a current claim.
