A furnished apartment rented to a traveling nurse for four weeks is often marketed as a mid-term rental. That description does not determine its federal passive-activity classification.

For the 30-day exception, your adviser needs information about both customer use and personal services. A booking calendar provides only part of that picture.

## What the 30-day exception asks

[Treasury Regulation 1.469-1T(e)(3)(ii)(B)](https://www.law.cornell.edu/cfr/text/26/1.469-1T) describes an exception when average customer use is 30 days or less and significant personal services are provided by or on behalf of the owner. This is one exception to the rental-activity definition; it is not the only possible exception.

For services, the regulation considers the relevant circumstances, including frequency, type, and value relative to the rental charge. It excludes certain services, including those needed for lawful use, construction or repair that extends useful life, and services similar to those commonly provided with long-term high-grade commercial or residential rentals.

Avoid treating every cleaning visit as decisive. Keep what was offered and performed so the adviser can assess the applicable standard. This Section 469 analysis is separate from Schedule C reporting and self-employment tax.

## Preserve customer rights, not just occupied nights

Keep the initial agreement, extensions, cancellations, and any change in the right to use the unit. A customer leaving early does not necessarily end their contractual right to use it. A renewal does not automatically create a separate customer-use period.

For example, preserve a 28-day agreement and a later 14-day extension together. Do not split them into separate short bookings merely because your platform issued two payment records.

Also retain periods spanning year-end. [Treasury Regulation 1.469-1(e)(3)(iii)](https://www.law.cornell.edu/cfr/text/26/1.469-1) supplies the average-use calculation, including property classes and income weighting where applicable. Let the reviewer see the complete agreements behind your summary.

## Keep a service ledger

For each service, note its date, description, provider, duration where known, and whether it was performed during occupancy or between customers. Retain the charge or value information and how the service was included in the rental arrangement.

An illustrative entry might read: “September 18: contracted housekeeper cleaned the occupied unit under the weekly service agreement; invoice attached. Owner spent 10 minutes coordinating access.” This distinguishes the service delivered from the owner’s participation.

Keep listing descriptions and service agreements with the records. An advertised amenity, an optional service, and a service delivered each day should not be collapsed into one statement that the property is “full service.”

## Ask the next question separately

An exception to rental classification does not by itself make a loss deductible against other income. Participation and other loss limitations still require review. If the 30-day exception is not met, your adviser can assess other applicable rules rather than treating the marketing label as the answer.

Clear answers

## Frequently asked questions

Does a 28-day booking automatically meet the 30-day exception?+

No. This exception also requires significant personal services, and the relevant measure is average customer use under the rules rather than one advertised stay length.

Does every cleaning service satisfy the personal-services condition?+

No. The nature, frequency, value, and applicable exclusions matter. Record the service details rather than assuming that a cleaning invoice settles the test.

Should a lease extension be treated as a separate short stay?+

Not automatically. Preserve the customer's continuous or recurring rights of use and the extension agreement so the correct period can be determined.

Does the 30-day exception decide Schedule C reporting?+

No. Rental classification under Section 469 and the reporting and self-employment-tax analysis are separate questions requiring their own review.
