A management agreement explains what a company promises to handle. It does not show every task you performed, or how the company’s work was divided among individual staff members.

If you still handle repairs, leasing decisions, or guest problems, record those actions separately. This gives your tax adviser something more useful than a management-fee total and an annual estimate of your own hours.

## Hiring a manager does not settle the tax result

The material participation tests ask different questions. Under [Treasury Regulation 1.469-5T(a)](https://www.law.cornell.edu/cfr/text/26/1.469-5T), Test 1 requires more than 500 hours. Test 2 concerns substantially all participation. Test 3 requires more than 100 hours and at least as much participation as any other individual.

A manager’s involvement can make some tests harder to meet, but hiring one does not automatically eliminate substantially all participation. The actual division of work matters. Under Test 3, a tie can satisfy the comparison; exactly 100 owner hours cannot satisfy its hours threshold.

Rental activities also have separate passive-activity rules. Meeting a participation test alone does not remove those rules for every rental. Start with your adviser’s assessment of the activity and applicable exceptions.

## Ask for people and tasks, not just fees

For a comparison with other individuals, a company-wide total can hide the relevant facts. Ask the manager whether their records identify staff members, service dates, tasks, and time attributable to your activity. Request the same distinction when a cleaning invoice covers a crew.

A flat monthly fee cannot reliably be converted into hours by dividing it by an assumed hourly rate. If a provider has only an estimate, keep its source and method. If the information is unavailable, tell your CPA rather than entering zero.

For example, an invoice showing a two-person crew on site for three hours may describe six labor-hours. It does not establish that either individual worked six hours. Clarify what the invoice measures.

## Record the part you handled

An illustrative entry might read: “September 8, Oak Street unit: spent 22 minutes reviewing the manager’s leak photos, calling the plumber, and authorizing access. Manager arranged the visit; plumber’s work recorded separately.”

That note distinguishes your coordination from the repair itself. Avoid claiming the full contractor visit as your work when you only approved it. When you attended, record what you did and the time you spent doing it.

Reviewing investment performance can also differ from operational management. Keep the action visible instead of assuming every email or report review belongs in qualifying time.

## Review the comparison before the handoff

Check names, duplicated visits, shared projects, and missing provider information. Preserve the management agreement alongside the activity records so your adviser can understand the division of responsibilities.

[Recording who did the rental work](/blog/record-who-did-rental-work/) explains how to keep owner and non-owner contributions distinct. HostHours organizes those records; it does not certify another person’s hours or determine which participation test you meet.

Clear answers

## Frequently asked questions

Does a property manager automatically prevent material participation?+

No. The available tests and actual division of work need review. A management contract alone does not establish the result, and rental passive-activity rules still matter.

Which test compares my hours with another individual?+

Test 3 requires more than 100 hours and at least as much participation as any other individual. Equal hours can meet the comparison, subject to the other applicable rules.

Can I calculate manager hours from their monthly fee?+

A flat fee does not establish hours. Ask for records or a documented estimate and preserve its limitations for professional review.

Should a cleaning crew be treated as one person?+

Keep each individual identifiable where possible. Crew labor-hours and the time spent by a single person are different measurements.
